And why shouldn't Wal-mart try this?
After all, what will it cost them? Like all large corporations, they either employ lawyers, or have one or more law firms engaged to work for them. There's no downside. What's the worst that could happen - the judge might kick it out of court. No big deal.
Since we don't have legislation that covers misuse of the law itself, with penalties that are big enough to hurt, corporate misuse of Trademark, Copyright, and Patent law will continue.
I am an Associate Professor at the University of Western Ontario jointly appointed to the Faculty of Law and the Faculty of Information and Media Studies (FIMS).
Before coming to Western, I was a law librarian at the Boalt Hall Law Library at the University of California at Berkeley and before that I was in private law practice in California. My doctoral work in the Department of Information Studies at UCLA focused on information policy issues.
